§ 1 Scope

These General Terms and Conditions ("Terms") apply to all contracts concluded between MITRAM GmbH (hereinafter "Seller") and the buyer (natural or legal person) via the online shop eleojewels.com. Deviating terms of the buyer are only recognised if the Seller expressly agrees to them in writing.

§ 2 Product Presentation & Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but a non-binding invitation to order. By submitting the order (clicking "Place order with obligation to pay"), the buyer submits a binding offer.

The contract is concluded when the Seller accepts the order by email confirmation or ships the goods. The Seller reserves the right to reject an order for comprehensible reasons (e.g. unavailability, payment issues, obvious price or description errors).

Product photos serve to provide the best possible representation but may, depending on the lighting and camera equipment used at the time of the shoot as well as the display settings of your device (e.g. smartphone, tablet, PC), differ slightly from the actual product's colour, sheen or appearance. Such a difference does not constitute a defect in the goods. Should product descriptions, prices or other details nevertheless be incorrect, we are entitled to correct obvious errors at any time; a contract based on such an error will not become effective or may be reversed.

§ 3 Prices and Payment

All prices are stated in euros. For standard-taxed items, the statutory VAT is included in the price shown. Shipping costs are shown separately at checkout.

Part of our range (in particular vintage and pre-owned jewellery) is subject to the margin scheme under § 24 of the Austrian VAT Act (UStG). For these items, VAT is not shown separately; a corresponding notice appears on the relevant product page.

The following payment methods are available: credit card (Visa, Mastercard, American Express, Diners Club), Apple Pay, Google Pay, Shop Pay, PayPal and Klarna. The payment methods actually displayed during checkout are decisive. Payment is due immediately upon completion of the order.

Instalment purchases under our Layaway programme are additionally subject to our separate Layaway Terms.

§ 4 Delivery & Shipping

Shipping takes place after receipt of payment. Delivery times: Austria 1–3 business days, Germany/Switzerland 2–4 business days, rest of Europe 3–6 business days, international 5–10 business days. Stated delivery times are estimates; we are not liable for delays caused by the shipping provider, customs clearance, or events beyond our control.

All parcels are shipped fully insured and discreetly (neutral outer packaging). The shipping risk passes to the buyer upon handover to the shipping provider, insofar as the buyer is a business. For consumers, the Seller bears the risk until handover to the buyer.

For deliveries outside the European Union, additional taxes, customs duties and import fees may apply in the destination country. These are not included in our prices or shipping costs and are the sole responsibility of the buyer. We recommend checking the expected amount with the relevant customs authority before placing your order.

§ 5 Retention of Title

The delivered goods remain the property of MITRAM GmbH until paid for in full.

§ 6 Right of Withdrawal (Consumers)

Right of withdrawal: Consumers have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you took possession of the goods.

To exercise the right of withdrawal, you must inform us (MITRAM GmbH, office@eleojewels.com) by means of a clear statement of your decision to withdraw from this contract. The returned goods must be in the same condition as received — unworn, undamaged, with tags attached and in the original packaging — and accompanied by the proof of purchase.

You are welcome to use our withdrawal form for this purpose, but are not required to.

Consequences of withdrawal: In the event of an effective withdrawal, we will reimburse all payments received, including delivery costs, without undue delay and at the latest within 14 days, to the original payment method. We may withhold reimbursement until we have received the goods back.

Exclusion: The right of withdrawal does not apply to goods that have been individually manufactured according to customer specifications (e.g. engravings, custom fittings).

Customers outside the EU: The statutory right of withdrawal under Austrian and EU law (FAGG) applies to consumers with a delivery address within the European Union. Customers with a delivery address outside the EU do not have a statutory right of withdrawal. Should we nevertheless accept a return in such a case as a goodwill gesture, the customer bears the return shipping costs as well as all costs incurred in connection with the return, in particular customs duties, import fees and any other charges incurred by us as a result. In this case, the risk of transport for the return shipment lies with the customer.

Returns by businesses (B2B): Where a return is made by a business customer within the meaning of these Terms, that business customer — by way of exception to paragraph 3 — bears the risk of transport for the return of the goods, unless expressly agreed otherwise.

§ 7 Warranty & Guarantee

The statutory warranty rights under Austrian law (ABGB, KSchG) apply. The warranty period is 2 years from delivery for consumers.

Every piece of jewellery is carefully inspected by our experts before shipping. Should you nevertheless receive a defective piece, please contact us immediately, stating your order number and photos of the defect.

§ 8 Intellectual Property

All content on this website — including text, images, graphics, logos and their design — is the property of MITRAM GmbH or its licensors and is protected by copyright. Use, reproduction or distribution of this content beyond private, non-commercial use requires our prior written consent. The names, logos and product designations of ELEO Jewels are trademarks of MITRAM GmbH.

§ 9 Permitted Use of the Website

You agree to use the website exclusively for lawful purposes and, in particular, not to: violate applicable law or third-party rights, use automated systems, bots, scraping tools or AI agents to access the website without our express consent, circumvent security or access restrictions, or misuse the website to distribute malware, spam or fraudulent content. In the event of violations, we reserve the right to block access and take legal action.

§ 10 Customer Reviews & Feedback

If you submit reviews or other feedback about our products or services, you grant us the right to use, publish and promote this content as part of our business activities. You warrant that your feedback is truthful, does not infringe third-party rights, and does not contain unlawful, offensive or misleading content. We reserve the right not to publish or to remove reviews that violate these principles.

§ 11 Liability

The Seller's liability for slight negligence is — to the extent legally permissible — limited to foreseeable, typical contractual damages. Liability for damages resulting from injury to life, body or health, as well as for gross negligence and intent, is unlimited. The mandatory provisions of the Austrian Consumer Protection Act (KSchG) in favour of consumers remain unaffected by this provision.

We assume no liability for the content of external linked websites or optional third-party tools accessible via our website; responsibility lies solely with their respective operators.

§ 12 Relationship with Shopify

ELEO Jewels operates via the Shopify platform. All purchases in our shop are made directly with MITRAM GmbH — Shopify is not a party to the purchase contracts and assumes no responsibility for damages or claims arising from your purchase. Further information on data processing by Shopify can be found in our Privacy Policy.

§ 13 Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy and the provisions of the GDPR and the Austrian DSG.

§ 14 Changes to These Terms

We reserve the right to amend these Terms as needed, for example due to changes in the legal situation or business practices. For contracts already concluded, the version valid at the time of the order applies. We will inform you of any material changes in an appropriate manner.

§ 15 Applicable Law & Jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for claims against businesses is the Seller's registered seat. Statutory jurisdiction provisions apply to consumers. For consumers residing in another EU member state, the mandatory consumer protection provisions of their home country additionally apply.

§ 16 Severability Clause

Should individual provisions of these Terms be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose of the invalid provision.

§ 17 Alternative Dispute Resolution

We are not obliged, and are not willing, to participate in dispute resolution proceedings before a consumer arbitration board. If you have a complaint, please feel free to contact us directly at office@eleojewels.com.

§ 18 Force Majeure

If we are unable, or unable in time or in full, to fulfil a contractual obligation due to events of force majeure (e.g. natural disasters, war, government measures, strikes, pandemics, failure of transport or IT infrastructure), our performance obligations shall be postponed for the duration of the disruption. If the disruption lasts longer than 30 days, either party is entitled to withdraw from the contract; any payments already made will be refunded in this case.

§ 19 Partial Deliveries

We are entitled to make partial deliveries insofar as this is reasonable for the buyer. This will not result in additional shipping costs for the buyer, unless the buyer has expressly requested the partial delivery.

§ 20 Form of Notices

Declarations and notices in connection with the contractual relationship (e.g. withdrawal, notice of defects) may be made in any form, in particular by email to office@eleojewels.com. For business customers, legally relevant notices must additionally be made in text form (email is sufficient).
